Ricardo Tosto is a Recognized Strategist

Brazil mainly derived its law from the Portuguese civil law, and its legal system is mostly based on statutes. However, there were constitutional amendments in 2004 that recognized previous court decisions as precedents in common law. Brazil has over one million lawyers with Sao Paolo being the largest legal center where 288, 975 lawyers are concentrated. Rio de Janeiro equally has many lawyers, who add up to 139, 714. Lawyers in Brazil are commonly known as Advogados.

The legal profession in Brazil is regulated by the state bars, which are overseen by the Brazilian Bar Association. The bar does not require the foreign lawyers to register their presence in their nation or even their intention to offer legal services in the nation. However, the foreign law firms are restricted in the scope of their activities and on how they relate with the local law firms or lawyers. These foreign lawyers are restricted from partnering with Brazilian lawyers or employing Brazilian lawyers unless the latter give up their titles. The foreign lawyers are also not allowed to appear in Brazilian courts or consult on Brazilian law.

For one to qualify as a Brazilian lawyer, they should pass the OAB examination. The lawyer only qualifies for the examination if they studied law in Brazil or in a school of law that uses AOB guidelines.

Thor Halvorssen Looks for Success in Helping Political Prisoners

Thor Halvorssen has been one of the world’s best respected human rights activists for a number of years after beginning his career as a student and shocking established activists with his knowledge and passion. It was during his time as a student at the University of Pennsylvania that Thor Halvorssen began his work as a human rights acitivist, initially in a bid to help his father escape his own incarceration that was illegal on many different levels in their native Venezuela. Halvorssen has also seen many different members of his own family targeted because of their political decisions and stripped of their human rights in many different ways.

Pivotal moments in the life of Thor Halvorssen include witnessing the 74 day incarceration of his father and the shooting of his own mother when she took part in a political demonstration that opposed the rule of Venezuelan president Hugo Chavez. Halvorssen has gone on to found his own activism group, the Human Rights Foundation that has been led by the Russian activist Gary Kasparov for a number of years; the Human Rights Foundation does not look to work on cases in democratic countries but instead focuses on closed societies where human rights are stolen from citizens on a regular basis.

In his work as an activist Thor Halvorssen has chosen to align himself with groups that are battling the most evil tyrants on the planet, including the Russian group “Pussy Riot”. It is not common for activist group leaders to place their own health on the line when they are looking to publicize the work they are bringing to the attention of the public; however, Thor Halvorssen has been known ton place his own body in the firing line as was seen in a trip he took to Vietnam to interview a political prisoner of over two decades. The reasons for Halvorssen’s visit to Vietnam were eventually discovered by the authorities who viciously beat both he and his camera operator in a bid to get hold of the tape of an interview Thor conducted earlier in his visit to the country.

Laidlaw And Relmada Lawsuit Continues

Laidlaw has recently been suffering under a series of lawsuits from Relmada Therapeutics Inc, in which it was claimed that principals Matthew Eitner and James Ahern broke their fiduciary duty as the company’s primary investment banker. Relmada claims that Laidlaw gave them materials that were false and misleading.

The claim isn’t that Laidlaw made an honest mistake, but willfully misled Relmada to cause them to lose money on its investment. So Relmada is attempting to receive damages for itself.

A recent change to this lawsuit includes a restraining order filed against Laidlaw by Relmada, due to the materials which they believed led them to make poor investment choices. This restraining order was filed to prevent Laidlaw from harming Relmada in ways that the company neglected to name.

Due to this information, Relmada claims that Laidlaw owes them money for damages and that steps must be taken to prevent it from harming Relmada in the future. This lengthy and difficult process began in late 2015, when Relmada claims the erroneous materials were given to them by Laidlaw.

Laidlaw, an investment firm with nearly 100 years of experience, has claimed innocence in the matter. Their experience offering advice to other companies in a variety of industrial sectors has given them high competence in their position, they claim. The idea that they misled Relmada purposefully or in some attempt to cause them failure has been denied.

The difficulty of sorting through this case is that much of the evidence is of the “he said, she said” variety. It’s simply Relmada’s position against Laidlaw’s, which has made it very awkward for a judge to file for either side.

The burden of proof is on Relmada to prove that Laidlaw willfully misled them, and this burden has proven to be a difficult one for Relmada to bear.
